- 1.3. Provider-Patient Relationship: Your use of our telemedicine services establishes a patient-provider relationship with the healthcare provider who conducts your telemedicine consultation.
2. Eligibility
- 2.1. Age: You must be at least 18 years old to use our telemedicine services. For minors, a parent or legal guardian must consent and accompany the minor during the telemedicine consultation.
- 2.2. Location: Our telemedicine services are available to users located throughout the United States of America, where telemedicine is legally permitted. You are responsible for complying with state laws and regulations related to the use of telemedicine.
3. User Responsibilities
- 3.1. Accuracy of Information: You agree to provide accurate and complete information during the registration process and throughout your use of our telemedicine services.
- 3.2. Technology Requirements: You are responsible for ensuring that you have the necessary technology and internet connection to access and use our telemedicine services.
- 3.3. Emergency Situations: Our telemedicine services are not intended for acute care or medical emergencies. In case of a potential or actual medical emergency, you should immediately seek in-person medical attention or call emergency services.
4. Privacy and Confidentiality
- 4.1. Privacy Policy: Our privacy policy governs the collection, use, and disclosure of your personal information. By using our telemedicine services, you consent to the terms of our privacy policy.
- 4.2. Confidentiality: We are committed to maintaining the confidentiality of your telemedicine consultations and medical records in accordance with California laws and professional standards.
5. Medical Advice and Treatment
- 5.1. Limitations: Our telemedicine services have limitations and may not be suitable for all medical conditions. The healthcare provider may determine that an in-person consultation or additional diagnostic tests are necessary at your own expense.
- 5.2. Prescriptions: If a prescription is provided as part of your telemedicine consultation, it will be based on the healthcare provider's independent clinical judgment and within the scope of their licensure. Controlled substances will not be prescribed nor refilled through our telemedicine service.
6. Fees and Payment
- 6.2. Insurance: Our telemedicine services are not eligible for reimbursement by any insurance plan.
- 6.3. Medicaid, Medicare, and Tricare: Due to regulatory restrictions and reimbursement limitations, patients covered by Medicare, Medicaid, or Tricare are ineligible to receive services offered through our telemedicine service. Patients covered by Medicare, Medicaid, or Tricare are encouraged to seek medical care through traditional in-person appointments with healthcare providers who accept their insurance coverage.
7. Modifications and Termination
- 7.1. Changes to Terms: We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on our website or notifying you through other means.
- 7.2. Termination: We may suspend or terminate your access to our telemedicine services at any time for violation of these Terms or for any other reason without prior notice.
8. Governing Law and Dispute Resolution
- 8.1. Governing Law: These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
- 8.2. Dispute Resolution: Any dispute arising out of or relating to these Terms shall be resolved through arbitration in accordance with the rules of the American Arbitration Association, and the decision of the arbitrator shall be final and binding.
